Welcome to KareAI. By accessing or using our mobile application, website, or any other services we provide (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and app. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

KareAI provides an AI-powered skin analysis platform that allows users to:

• Take selfies for AI-based skin analysis
• Receive personalized skin health scores and insights
• Track skin health progress over time
• Get product recommendations based on skin profile
• Chat with an AI assistant for skincare advice

Our Service is intended for informational purposes only and should not be considered medical advice. Always consult with a qualified healthcare professional or dermatologist for medical concerns.

To use our Service, you must be at least 13 years of age. If you are between 13 and 18 years old, you must have parental or guardian consent to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

5.1 Subscription Plans

KareAI offers subscription-based access to premium features. Subscription options and pricing are displayed within the app and may change from time to time.

5.2 Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan). Payment is processed through the App Store, Google Play, or our website payment provider (Stripe via RevenueCat).

5.3 Automatic Renewal

Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage your subscription and turn off auto-renewal through your account settings.

5.4 Refunds

Refund requests for subscriptions purchased through the App Store or Google Play must be submitted through the respective platform. Subscriptions purchased through our website may be eligible for refunds within 7 days of purchase if you have not used any premium features.

5.5 Scan Credits

Some subscription plans include a limited number of skin scans per billing period. Additional scan credits may be purchased separately. Unused scan credits from your subscription allocation may expire at the end of each billing period, while purchased bonus credits do not expire.

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Upload malicious content or malware
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Service
• Upload photos that are not of your own skin
• Share accounts or credentials with others
• Use the Service for commercial purposes without authorization
• Reverse engineer, decompile, or attempt to extract our AI models or algorithms

7.1 Your Content

You retain ownership of any photos or content you submit to the Service ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing and improving our Service.

7.2 Content Restrictions

You may not upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable. We reserve the right to remove any content that violates these Terms.

The Service and its original content (excluding User Content), features, and functionality are owned by KareAI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our AI models, algorithms, analysis methods, and the "Kare" mascot character are proprietary to KareAI. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted or error-free
• Warranties that results will be accurate or reliable

IMPORTANT: Our AI skin analysis is not a substitute for professional medical advice, diagnosis, or treatment. The results and recommendations provided are for informational purposes only. Always seek the advice of a qualified dermatologist or healthcare provider for any skin conditions or concerns.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAREAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or revenue
• Loss of data
• Loss of goodwill
• Personal injury or emotional distress

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless KareAI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any User Content you submit

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through the app settings or by contacting us. All provisions of these Terms that should survive termination shall survive.

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

13.2 Arbitration

Any dispute arising from or relating to these Terms or the Service shall be resolved by binding arbitration in accordance with the American Arbitration Association rules. The arbitration shall be conducted in English and the arbitral decision may be enforced in any court.

13.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

• Entire Agreement: These Terms constitute the entire agreement between you and KareAI regarding the Service.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver.
• Assignment: You may not assign or transfer these Terms without our prior written consent.
